1. Introduction

These Terms & Conditions ("Terms") govern your use of the Charity App mobile application and website (the "Service"), operated by CueBytes ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

2. About the Service

Charity App is a platform that enables individuals to make charitable donations to registered charities. The Service facilitates:

  • Secure card-based donations processed via Stripe.
  • Gift Aid declarations for UK taxpayers.
  • Generation and delivery of donation receipts.
  • Tap-to-pay donation collection for charities.

We act as a technology provider facilitating donations between donors and charities. We are not a charity ourselves and do not solicit donations on behalf of any organisation.

3. Eligibility

To use the Service, you must:

  • Be at least 16 years of age.
  • Have the legal capacity to enter into a binding agreement.
  • Provide accurate and complete information when making a donation.

4. Donations

4.1 Making a Donation

When you make a donation through our Service:

  • You confirm that you are the authorised holder of the payment card used.
  • You understand that donations are voluntary and made at your own discretion.
  • You acknowledge that the donation amount, plus any optional fee coverage, will be charged to your payment method.

4.2 Refunds

Donations are generally non-refundable once processed. However, if you believe a donation was made in error or without your authorisation, please contact us at donations@fundraisetap.com within 14 days. We will review each request on a case-by-case basis.

4.3 Transaction Fees

A small transaction fee is applied to cover payment processing costs. You may choose to cover this fee so that the full donation amount reaches the charity. Fee amounts are clearly displayed before you confirm your donation.

5. Gift Aid

If you are a UK taxpayer and elect to add Gift Aid to your donation:

  • You declare that you are a UK taxpayer and understand that if you pay less Income Tax and/or Capital Gains Tax than the amount of Gift Aid claimed on all your donations, it is your responsibility to pay any difference.
  • The charity will claim an additional 25% from HMRC based on your donation.
  • Your name and address details will be shared with the charity and may be submitted to HMRC as required.
  • You must notify the charity if your tax status changes.

6. Payment Processing

All payments are processed securely by Stripe, a PCI DSS Level 1 certified payment processor. By using the Service, you also agree to Stripe's Terms of Service.

We do not store your full payment card details on our servers.

7. User Responsibilities

When using the Service, you agree to:

  • Provide accurate and truthful information, including your name, email, and address.
  • Not use the Service for any unlawful or fraudulent purpose.
  • Not attempt to interfere with, disrupt, or compromise the Service's security or infrastructure.
  • Not use automated systems or bots to access the Service.

8. Intellectual Property

All content, design, logos, and software associated with the Service are owned by CueBytes and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Disclaimers

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.
  • We are not responsible for the actions, policies, or practices of any charity listed on the platform.
  • We do not guarantee the tax-deductibility of any donation. Donors should consult their own tax advisors regarding Gift Aid eligibility.

10. Limitation of Liability

To the maximum extent permitted by law:

  • CueBytes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
  • Our total liability to you for any claims arising from the Service shall not exceed the total amount of donations you have made through the Service in the preceding 12 months.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
